Terms of service

These terms of service ("Terms") govern your access to and use of WisebotAI websites, software, and services (collectively, the "Services"). By using the Services, you agree to these Terms.

1. The Services

WisebotAI provides AI-powered customer support and related automation features. We may change, suspend, or discontinue parts of the Services with reasonable notice where practicable. Feature descriptions and limits may be set out in the product, order forms, or documentation.

2. Your account

You are responsible for the accuracy of information you provide, safeguarding credentials and API keys, and all activity under your account. You must be legally able to enter a binding contract in your jurisdiction to use the Services in a commercial capacity, unless we expressly allow a different arrangement.

3. Acceptable use

You agree not to misuse the Services, including by:

• Violating applicable laws or others' rights
• Attempting to probe, scan, or test vulnerabilities without authorization
• Reverse engineering except to the limited extent allowed by law
• Overloading, disrupting, or interfering with the Services or other users
• Using the Services to generate or distribute clearly unlawful or harmful content

4. Your content and data

You retain your intellectual property in content you submit. You grant WisebotAI the rights needed to host, process, and display that content to provide the Services, improve reliability and security, and as described in our Privacy policy. You are responsible for having the rights to any data you import or connect, including personal data of your end users where applicable.

5. Subscriptions, fees, and taxes

If you purchase a paid plan, you agree to the fees and billing cycle shown at purchase or in an order form. Unless stated otherwise, fees are non-refundable. You are responsible for applicable taxes, except for taxes on WisebotAI's net income.

6. Warranties and disclaimer

The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. AI outputs may be incorrect or incomplete; you should not rely on them as sole advice for high-risk decisions without human review.

7. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, except to the extent caused by willful misconduct or where liability cannot be limited by law. Our aggregate liability for all claims related to the Services in any twelve-month period is limited to the amount you paid us for the Services in that period (or, if the Services are free, one hundred U.S. dollars), except for claims that cannot be limited by law.

8. Termination

You may stop using the Services at any time. We may suspend or terminate access for material breach, risk to the Services, or as required by law, with notice when reasonable. Provisions that by their nature should survive will survive termination.

9. Changes to these Terms

We may update these Terms from time to time. We will post the new Terms on this page and update the "Last updated" date. Material changes may also be notified by email or in-product notice where appropriate. Continued use after the effective date constitutes acceptance of the updated Terms, except where your consent is required by law.

10. Governing law

These Terms are governed by the laws of the State of Delaware, United States, excluding its conflict of law rules, and the federal courts in Delaware (or, where you are a consumer, the laws and courts of your home jurisdiction as required by mandatory consumer law). If any provision is unenforceable, the remainder stays in effect.
